Terms and Conditions
Effective Date: March 4, 2026
These Terms and Conditions ("Terms") govern the services provided by Casey Manuel Photography ("Photographer," "we," "us," or "our") to clients ("Client," "you," or "your"). By booking, signing a contract, or using our services, you agree to be bound by these Terms in full. Please read them carefully before proceeding.
1. Services
Casey Manuel Photography provides professional photography services including, but not limited to, wedding and event photography, portrait and family sessions, and commercial and branding photography. The specific scope of services, session details, deliverables, and pricing will be outlined in a separate written contract or booking confirmation signed by both parties.
All services are subject to availability. We reserve the right to decline any booking at our discretion.
2. Booking and Payment
a. Retainer
A non-refundable retainer fee is required at the time of booking to secure your session date. This retainer is applied toward the total balance due. Your date is not confirmed until the retainer is received and a signed contract is in place.
b. Payment Schedule
The remaining balance is due as specified in your individual contract. Failure to remit payment by the due date may result in cancellation of services without refund of the retainer.
c. Accepted Payment Methods
Accepted payment methods will be communicated at the time of booking. All payments must be made in U.S. dollars.
3. Cancellations and Rescheduling
a. Client Cancellation
If you cancel your booking, the retainer is non-refundable. Cancellations made within 30 days of the scheduled session date may result in forfeiture of any additional payments already made, depending on the terms of your signed contract.
b. Rescheduling
One complimentary reschedule may be permitted with at least 14 days' notice, subject to availability. Rescheduling requests made with fewer than 14 days' notice may be treated as a cancellation.
c. Photographer Cancellation
In the unlikely event that Casey Manuel Photography must cancel due to an emergency or unforeseen circumstance, we will make every effort to provide a qualified substitute photographer. If no substitute is available, a full refund of all payments received will be issued. Our liability is limited to the amount paid and does not extend to consequential damages.
4. Copyright and Intellectual Property
a. Ownership of Images
All photographs produced by Casey Manuel Photography are original creative works and remain the exclusive intellectual property of Casey Manuel Photography. All rights, title, and interest in and to the photographs — including all copyright — are and shall remain solely owned by Casey Manuel Photography.
b. No Permission Without a License
IMPORTANT: No person, entity, or organization is permitted to reproduce, copy, print, publish, display, distribute, alter, sublicense, sell, or otherwise use any photograph produced by Casey Manuel Photography without a valid, written license expressly granted by Casey Manuel Photography. Unauthorized use of any image — including screenshots, digital downloads, or reproductions from any source — is strictly prohibited and constitutes copyright infringement under the United States Copyright Act (17 U.S.C. § 101 et seq.).
This prohibition applies regardless of the medium — including but not limited to print, social media, websites, advertising, broadcast, and commercial use — and regardless of whether the image is credited or attributed to Casey Manuel Photography.
c. Client Personal Use License
Upon receipt of full payment, clients are granted a limited, non-exclusive, non-transferable license to use their delivered photographs for personal, non-commercial purposes only. This includes printing for personal use and sharing on personal social media accounts, provided that credit is given to Casey Manuel Photography where applicable.
This personal use license does not grant any right to: sell or commercially exploit the images, sublicense the images to third parties, use the images in advertising or for-profit campaigns, or alter, crop, filter, or modify the images in a way that misrepresents the work.
d. Commercial Licensing
Clients requiring commercial use of images — including use in advertising, product packaging, editorial publication, or any for-profit context — must obtain a separate written commercial license from Casey Manuel Photography prior to such use. Commercial licensing fees are negotiated separately and are in addition to session fees.

e. Third-Party Use
Vendors, venues, planners, and other third parties who appear in or receive copies of images from a client do not receive any license to use those images. Any third-party use requires a separate written license from Casey Manuel Photography.
5. Photographer's Portfolio Rights
Casey Manuel Photography reserves the right to use any photographs taken during a session for portfolio, website, social media, marketing, competition, and educational purposes, unless the Client has requested otherwise in writing prior to the session. Images used for portfolio purposes will be handled with discretion and care.
Clients who wish to keep all images private must notify us in writing before the session. A privacy fee may apply.
6. Delivery of Images
Edited images will be delivered within the timeframe specified in your service contract. Delivery timelines vary by service type and will be communicated at booking. Typical delivery times are:
Portrait and family sessions: 2–3 weeks
Wedding and event coverage: 6–10 weeks
Commercial sessions: as agreed in the project contract.
Images are delivered via a secure online gallery link. It is the Client's responsibility to download and back up their images within the gallery's active period. Casey Manuel Photography is not liable for image loss after the gallery expires.
7. Client Responsibilities
To ensure the best possible results, Clients agree to:
Provide accurate event details, timelines, and location information in advance.
Ensure access to all locations and venues where photography is required.
Obtain any necessary permits or permissions for photography at third-party locations.
Communicate any special requests, must-have shots, or sensitivities before the session.
Casey Manuel Photography is not responsible for missed shots resulting from incomplete information, scheduling conflicts caused by the client, or restricted access to locations.
8. Limitation of Liability
In the event of equipment failure, illness, accident, or other circumstances beyond our control that prevent the delivery of services or images, Casey Manuel Photography's total liability shall be limited to a refund of amounts paid. We are not liable for any indirect, incidental, consequential, or punitive damages arising from the use or inability to use our services.
We strongly recommend that clients obtaining wedding or large event coverage also contract with a second photographer as a precaution.
9. Model Release and Likeness
By proceeding with a session, Clients grant Casey Manuel Photography a limited license to use session images for portfolio and marketing purposes as described in Section 5, unless a written opt-out is submitted before the session.
For commercial sessions, a separate model release agreement will be provided and must be signed before the session takes place. Casey Manuel Photography complies with California Civil Code § 3344 regarding the use of an individual's likeness for commercial purposes.
10. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising from these Terms or the services provided shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in the county where the services were rendered, in accordance with California law.
11. Entire Agreement
These Terms, together with any signed service contract and booking confirmation, constitute the entire agreement between Casey Manuel Photography and the Client. They supersede all prior discussions, representations, or agreements. Any modifications must be made in writing and signed by both parties.
